   1. “We” means PT Keramika Indonesia Assosiasi Tbk.
   2. "SCG Companies" means PT Keramika Indonesia Assosiasi Tbk.  and its affiliated companies listed in the Appendix.
   3. “You” means individuals who are our customers or potential customers, as well as contact persons, legal representatives, directors, employees, staff, advisors of our customers or potential customers, or other individuals acting on behalf of customers or potential customers.
   4. “Processing” means collecting, analyzing, storing, correcting, updating, displaying, announcing, transferring, disseminating, using, disclosing, deleting, and/or destroying personal data.
   5.  “Personal data” means any data relating to an identified or identifiable natural person that can be identified on its own or in combination with other information directly or indirectly through an electronic or non-electronic system.
2. Purposes of Processing
   1. Contractual Necessity: We process your personal data because it is necessary to perform contracts between you and us. This includes:
      1. Providing you with services and products
      2. Managing your account
      3. Making deliveries
      4. Proceeding with accounting and financial matters

   1. Sources of Data Collection: We collect personal data directly from you and indirectly from reliable sources such as public organizations, SCG Companies, recruitment platforms, business partners, individuals who can legitimately disclose your personal data, and trusted service providers.
   2. Use of Services and Membership: When you use our services, purchase our products, join our loyalty program, or use our website or application, we collect the following personal data:
      1. Personal Information: Name, mobile number, email.
      2. Contact Information: Email address, telephone number, and home address.
      3. Provided Data: Personal data you have given to us when you contact us, request our after-sales services, or participate in our research or interviews.
   3. Online Interactions: When you visit our website or application or purchase our products or services online, we collect the following personal data:
      1. Registration Information: Name, email address, and mobile number.

Specific Personal Data: If we need to process specific personal data (e.g., personal financial data, health data, biometric data, or other sensitive data as defined by the law), we will clearly inform you of the types of specific personal data we collect and the reasons for processing either in this privacy notice or through other appropriate channels. We will process such data in strict compliance with the law and regulations and implement appropriate safeguards to ensure its security and confidentiality.

Third-Party Data Disclosure: If you disclose the personal data of others to us, you must be able to do so lawfully and comply with PDP Laws, including informing the data subjects of this privacy notice and other relevant documents and obtaining necessary consent before or at the time of disclosure.

5. Consent, Withdrawal, and Consequences
   1. Right to Withdraw Consent: If we rely on your consent to process personal data, you can withdraw your consent at any time. Withdrawal will not affect the validity of processing carried out before the withdrawal.
   2. Consequences of Withdrawal or Refusal: Withdrawing your consent or refusing to provide certain information may result in our inability to fulfill some or all objectives stated in this privacy notice.
   3. How to Withdraw Consent: You can withdraw your consent by following the instructions provided in the channels where consent was obtained (e.g., changing settings in your user account) or by sending an email to [email protected].
   4. Consent for Minors and Incapacitated Persons: If you are a minor, incompetent person, or incapacitated person and wish to give consent, you must obtain authorization from your guardians or conservators before giving consent.

6. Retention Period
   1. Data Retention Duration: We will retain your personal data for the period necessary to meet the stated objectives. We may retain certain data for up to 30 years3 (three) years to defend against legal claims. If the retention period is unclear, we will retain the data for a customary period in accordance with retention standards.
   2. Data Deletion and Destruction: We have established an auditing system to delete or destroy your personal data when the retention period expires or when it becomes irrelevant or unnecessary for the purposes it was collected.

   2. Separate Privacy Notices: Recipients of your personal data listed in clause 7.1 may have their own privacy notices. Please read their privacy notices to understand how they process your personal data.
   3. Business Restructuring: If we restructure our business, sell or transfer assets, acquire businesses, or merge with other businesses, we may disclose your personal data to our counterparties and advisors. We will do our best to safeguard your data and require our counterparties and advisors to comply with PDP Laws and this privacy notice.
   4. Protection Measures: We will require recipients of your personal data to take appropriate measures to protect your personal data, process it properly and only as necessary, and prevent unauthorized use or disclosure.
8. International Transfer of Your Personal Data
   1. Purposes of Transfer: We may send or transfer your personal data to SCG Companies or other entities located outside of Indonesia for the following purposes:
      1. You have explicitly consented to the proposed transfer after being informed of the possible risks due to the absence of an adequacy decision and appropriate safeguards;
      2. The transfer is necessary for the performance of a contract between you and us or the implementation of pre-contractual measures taken at your request;
      3. The transfer is necessary for the conclusion or performance of a contract concluded in your interest between us and another natural or legal person;
      4. The transfer is necessary for important reasons of public interest;
      5. The transfer is necessary for the establishment, exercise, or defense of legal claims;
      6. The transfer is necessary to protect your vital interests or those of other persons when you are physically or legally incapable of consent.
   2. Data Storage and Processing: We may store your personal data on servers or clouds outside Indonesia and use software or applications from service providers outside Indonesia. We ensure that unrelated parties do not access your personal data and require service providers to implement appropriate security measures.

We require recipients to implement protection measures, process the data only as necessary, and prevent unauthorized use or disclosure.

       7. Right to Restriction: To request us to suspend the use of your personal data.

       10. Right to Lodge Complaints: To file complaints with the Personal Data Protection Authority if we, our data processors, employees, or contractors violate or do not comply with PDP Laws.
    2. Processing of Rights Requests: We will consider your request, notify you of the result, and execute it (if appropriate) within the period set by PDP Laws from the date we receive the request. Your rights will be processed following PDP Laws.
